It is well known that fast cars are dangerous. Here is a short list of people we’ve all know of who have died in a car accident as a driver or a passenger in a car that was being driven too fast: Paul Walker, Ryan Dunn, James Dean, and Princess Diana.
We all see fast drivers speeding around on the streets. We see them on the freeways coming within inches of hitting other vehicles when they are moving in and out of lanes to avoid decelerating. For the driver of those cars, driving at a fast speed is a thrill. However, for the rest of us it is a frightening experience to be driving near them.
Report of A Car Accident
When one of my sons was just 7 years old, he looked at the speedometer on my car. He asked if the car goes as fast as last number on the speedometer, which was 130. I replied that I did not know if the car goes that fast because I have never attempted to drive it that fast and to do so could result in someone dying. He replied, “then why do they make cars that can go that fast if they know that it will kill us to drive that fast?” My reply was, “I don’t know why.”
The reason I decided to write this article is because I have witnessed people lose control of their vehicles when driving too fast. I also read an article today, September 2, 2020, about a 22-year-old that lost control of his Dodge Charger. He went over the center median and collided with a light pole at an intersection. Unfortunately, one of the passengers in that car lost their life because of the crash. Now the family of that deceased passenger is filing a wrongful death claim against the driver. Other passengers in the vehicle also had injuries in the car accident. They too will have the right to file a claim against the driver. Our thoughts and prayers go out to all the people that were involved in this terrible accident.
The driver of the Dodge Charger was 22 years old at the time of the accident. He is an adult, but still a young man. As we all know, a fast car in the hands of a 22-year-old creates a dangerous situation. A Dodge Charger is known for being a fast car with lots of power.

What Is The Solution?
There are no laws preventing the sale of such a car to any adult. Perhaps there should be at least a required governor placed on such vehicles to prevent them from exceeding a certain speed until the owner / driver is of a certain age. We can possibly look at car accident statistics to determine when is a safe age for an owner / driver to have the governor removed from the car. I believe there should also be laws that prevent vehicles from driving faster than 95 mph, since there is no conceivable situation where a person would legally be able to drive faster than 95 mph on public streets and highways. 95 mph is still too fast to drive on certain roadways. But at least the occupants and anyone crashed into would have a better chance of survival if this were the top speed for motor vehicles.
Wrongful Death Claim After a Car Accident Happens
When someone loses their life in a car accident such as this, the wrongful death claim alone is likely to be worth more than the insurance policy limits, which will mean that all the claimants will want to also research the driver’s net worth, current earnings and earning potential to determine if it would be worth it to file a lawsuit to pursue a judgment for their damages. There is no amount of money that can replace a loved one. However, it is undeniable that each person’s life has a value. It is very difficult to place a value on the loss of a loved one. However, it must be done. It is the only way that our legal system provides a remedy to the person or persons that had injuries.
For a wrongful death claim, in California, the way we measure damages for the loss of our loved ones is as follows: reasonable funeral and burial expenses, estimated amount of income and benefits the deceased person would have earned in their lifetime had the accident not occurred, loss of financial support for the household, loss of services around the household and loss of intangible support such as love and affection.
When it comes to fast cars and harm they can do to the people that drive them and the people driving near them, the better remedy would be to change the laws to keep people safer, but the reality is that auto manufacturer profits outweigh public safety, and therefore, we are left with determining the value of our health and our loved ones when fast cars result in big injuries or even death.
